3 months ago, the Indian government came out with a fresh set of IT rules. These rules are wide, giving the government power over any company in India that deals in information and the content within India. Almost all Digital companies, whether they are social media networks, messaging services, news organization or even streaming services like Netflix, Amazon, all have to follow the new rules.
The deadline to do so, that is to comply with the new IT rules, expires on 26 May.
After this, the big question is, Will Instagram be banned in India from today or tomorrow?, Unlikely.
But if Instagram do not comply with the new IT rules they will always be at the risk of a significant government action against them.
Government New IT Rules:
To understand this, let’s first take a look at new IT Rules.
Some significant New IT Rules :
- As per new IT Rules, “Big tech companies, the government calls them “significant social media”, must have a chief compliance officer in India who can respond to government demands and needs whenever required.
- The tech companies have also been asked to hire a nodal officer, who will coordinate with Indian law enforcement agencies round the clock, whenever the government requires.
- The social media companies have been asked to hire a grievance redressal officer, whom the Social Media users will be able to approach with their grievances if they have any.
There are more rules like this, but most of them involve technological and policy changes that the tech companies have been told to implement. The above mentioned 3 requirements, however, are more important. When the Indian government came out with the rules on 25 February, it said that companies have 3 months to comply.
So, the big question is: what happens next? Will Instagram be banned in India?
So far, most big tech companies have not yet complied with the new It rules. Facebook, which also owns Instagram and Whatsapp, says that “we aim to comply with the provisions of the new IT rules and continue to discuss a few of the issues which need more engagement with the government.”
But what if they fail to comply or cannot comply? Government has not specified much, beyond putting out a statement in its rules. Here is what it says:
“Where an intermediary fails to observe these rules, the provisions of sub-section (1) of section 79 of the Act shall not be applicable to such intermediary and the intermediary shall be liable for punishment under any law for the time being in force including the provisions of the Act and the IPC.”
Is Instagram is going to Banned?
Nothing much in the short term. Instagram, whether it manages to comply with the new rules, will continue to work in India.
But these services, if they do not comply with the government new IT rules, will work only until the government does not move against them.
If the Indian government decide to move against them, the action is unlikely to be blocking the services. Instead, it is likely to take other punitive measures.
